Privacy Policy

This policy explains what information SportsClock collects when you use the app and how it's used. By using SportsClock, you agree to the collection and use of information as described here.

1. Who we are

SportsClock is operated by Commercial Spaces Limited, a company registered in New Zealand (NZBN 9429041982631). Postal address: PO Box 1097, Christchurch, New Zealand. In this policy, “we”, “us” and “our” mean Commercial Spaces Limited. We are the data controller responsible for the personal information described here.

This policy applies to the SportsClock website at sportsclock.ai and the SportsClock mobile app (together, the “Service”).

2. Summary

We collect the minimum we need to show you accurate event times, remember your settings, and let you share events with people you choose. We do not sell your personal information. We use email marketing only if you actively opt in, and you can withdraw at any time. This section is a summary only, and the sections below govern.

3. Information we collect

Information you give us

  • Account details: your name and email address when you register.
  • Preferences: your home city, country, time zone, favourite sports, leagues and teams, and any travel destination you enter.
  • Content you create: notes, watch locations, and invitations you send when sharing an event or creating a watch party.
  • Correspondence: messages you send us, including support requests.

Information we collect automatically

  • Approximate location: an approximate city and country derived from your IP address, used to set your local time zone and personalise event listings. We do not collect precise GPS location.
  • Usage data: pages and screens viewed, features used, buttons tapped, searches run, calendar exports, shares and invitations created, session length and frequency.
  • Device and technical data: device type, operating system, browser type and version, language, referring URL, and IP address.
  • Cookies and similar technologies: see section 9.

Information about other people: If you invite someone to watch an event, we process the contact details you provide for that person in order to deliver your invitation. We use those details only to send the invitation and any directly related reminder. You are responsible for ensuring you have the right to share another person's contact details with us. If you receive an invitation and would like your details removed, contact us at info@commercialspaces.co.nz.

We do not collect sensitive information as defined by applicable privacy law, and we ask that you do not include it in notes or messages.

6. Who we share information with

We do not sell your personal information, and we do not share it for cross-context behavioural advertising.

We share personal information with:

  • Service providers who process information on our instructions to operate the Service. Our current providers are listed in section 15, and we keep that list current.
  • Other users, but only where you choose to share. If you invite someone to an event or watch party, they see the information you include in that invitation.
  • Professional advisers, including lawyers, accountants and insurers, where necessary and under a duty of confidence.
  • Authorities and third parties where we are required by law, or where we reasonably believe disclosure is necessary to protect our rights, your safety, or the safety of others.
  • A buyer or successor, as described in section 10.

All service providers are bound by written agreements requiring them to keep your information secure and to use it only for the purposes we specify.

7. International transfers

We are based in New Zealand and our service providers may store or process personal information in countries such as the United States, the European Union, and Australia.

Where we transfer personal information out of the EEA or the UK, we rely on an adequacy decision where one applies, or otherwise on the European Commission's Standard Contractual Clauses (and the UK International Data Transfer Addendum where relevant), together with any additional safeguards required.

Where we disclose personal information outside New Zealand, we take reasonable steps to ensure the recipient is required to protect it with safeguards comparable to those in the Privacy Act 2020, as required by information privacy principle 12.

8. How long we keep information

Aggregated or anonymised data that can no longer identify you may be kept indefinitely.

9. Cookies and analytics

We use cookies and similar technologies to keep you signed in, remember your preferences, and understand how the Service is used.

  • Strictly necessary: authentication, security, and load balancing. These cannot be switched off.
  • Preference: remembering your home location, time zone and display settings.
  • Analytics: Base44 and Google, used to measure feature usage and diagnose problems.

Where required by law, we ask for your consent before setting non-essential cookies, and you can change your choices at any time through the cookie settings link on our site. You can also block or delete cookies through your browser, though parts of the Service may not work properly if you do.

We do not use advertising or cross-site tracking cookies.

10. Business transfers

If we are involved in a merger, acquisition, financing, reorganisation, bankruptcy, or a sale of some or all of our assets, your personal information may be disclosed to the counterparty and its advisers as part of due diligence, and may be transferred as part of that transaction. Information disclosed during due diligence is provided under confidentiality obligations and, where practicable, in aggregated or pseudonymised form.

Any successor will be bound by this policy in respect of information transferred to it, unless and until you are notified of a change. We will notify you of a material change of ownership through the Service or by email within 30 days of completion, and any new policy will apply only after we have given you that notice.

Your rights under section 11 continue to apply after any transfer.

11. Your rights and choices

You can:

  • Access the personal information we hold about you, and request a copy.
  • Correct information that is inaccurate or incomplete.
  • Delete your account and associated personal information, from within the app or by contacting us.
  • Export your data in a portable, machine-readable format.
  • Withdraw consent to marketing at any time.
  • Object to processing based on legitimate interests, including profiling, on grounds relating to your particular situation.
  • Restrict processing in certain circumstances.

Manage most of this yourself from the settings page. For anything else, email info@commercialspaces.co.nz. We respond within 20 working days, and within one month where the GDPR applies. We may ask you to verify your identity first. These services are free, unless a request is manifestly unfounded or excessive.

12. Security and breach notification

We protect personal information using encryption in transit (TLS) and at rest, access controls limited to staff who need it, regular backups, and periodic review of our security practices. No system is completely secure, and we cannot guarantee absolute security.

If a privacy breach occurs that is likely to cause serious harm, we will notify the Office of the Privacy Commissioner and affected individuals as required by the Privacy Act 2020. Where the GDPR applies, we will notify the relevant supervisory authority within 72 hours where required, and affected individuals without undue delay where the breach is likely to result in a high risk to their rights and freedoms.

13. Children

The Service is not directed at children and we do not knowingly collect personal information from anyone under 16. If you are under 16, please do not register or send us your information. If we learn that we have collected information from a child under 16 without appropriate consent, we will delete it promptly. If you believe a child has provided us with personal information, contact info@commercialspaces.co.nz.

14. Complaints

If you are not satisfied with how we have handled your information, contact us first at info@commercialspaces.co.nz so we can try to resolve it.

15. Service providers

We currently use the following providers to operate the Service. We update this list when our providers change. Material changes are notified under section 17.

16. United States residents

If you are a resident of California or another US state with comprehensive privacy legislation, you have the right to know what personal information we collect, to access and delete it, to correct it, and to opt out of sale or sharing. We do not sell personal information and we do not share it for cross-context behavioural advertising as those terms are defined under the California Consumer Privacy Act. We will not discriminate against you for exercising your rights. To make a request, email info@commercialspaces.co.nz.

17. Changes to this policy

We may update this policy as the Service develops or the law changes. The version number and effective date at the top of this page always show the current version. If we make a material change, we will notify you by email or through the Service at least 14 days before it takes effect. Where a change requires your consent under applicable law, we will ask for it.
